This is a serious matter.  :hug005:

. You could sue the driver for liability but might have difficulty collecting. Was the driver working for anyone when he hit you (that's "vicarious liability")?

Talked to a lawyer friend who lives/ works in kentucky. "quote" The "Commonwealth" of Kentucky is a " No fault " state as far as auto accidents are concerned especially one's with no outside witnesses. Even though it is obvious to the police what happened, BOTH parties involved agreed exactly what happened, and such. Adding that "gramps" was NOT sited at the time of the incident, regardless. My chances of getting any type of judgement, not to mention collecting on one is, " Slim to none, and Slim moved out of town and didn't leave a forwarding address.

  So as I said My health insurance will pick up my medical bills which have been minimal.  I'm just basically out my pay for the duration. There again to mostly my Wife's side of our preps we have a good emergency fund to fall back on so the bills get paid. The one option I do have is IF I miss 2 months work I can collect on my temporary disability at work and it would back up and pay me from day one for missed wages. However I don't plan on missing much more work. Hope to go back next week.

 The good point of this incident is a learning experience not only( hopefully ) for me but everyone here.  DON'T JUST PREP  with the three B's ( beans, bullets, bandaids)  because things you don't expect have a way of sneaking up to bite you on ths A....... elbow.

Tom, would "uninsured motorist" have covered this one? If not, I can't think of how to have prevented this situation. Disability doesn't kick in until a waiting period, and that's actually to your advantage, or you would not be able to afford it.

This is a bizarre situation: no liability, and uninsurable against!

 Newest update.  Went back to Dr. yesterday, saw a different one this one listened to my problem and ordered an X-ray 9 first one didn't) after the X-ray ordered an ASAP MRI, had that this morning an go back to Dr. # 2 tommorow at 0830. Will let ya all know what happens then.   Don

 Latest update had MRI yesterday. Met with new Dr. today. MRI shows injuries WERE NOT back and shoulder but my neck. Next stop neurologist, waiting to here when. BUT on a good note, new Dr. contacted work comp rep. seems due to new information they have decided to pay my bills and lost wages. What changed??? I don't know maybe the Dr.s call or the fact I told the guy at work who handles work comp i had called a lawyer and was going to sue the crap out of the insurance company.  Which ever way, looks like I'm gonna get medical bills and wages paid by comp.  I'll keep you updated.

I hope you're feeling better ,

Insurance company standard practice is to almost always reject the claim the first pass.

they figure a certain percentage will drop off. most certainly they stall for time.

my medical procedures were first denied because they said I was too young to have these as recc'ed by govnt. etc.

second pass they paid them pretty much in full.


OTOH , FL is a no fault state as well, but my auto accident claim on the other company was paid in full immediately in days, may have had something
to do that nobody was not in my car at the time and the other driver admitted fault and got cited.

So the insurance company said no payment. Which I understand their point of view. I could sue him but I didn't/don't see that as an option because I had other payment options.

You can sue, but the problem often is one of collecting. The court will award you damages but unless you are someone special not help you collect them.

Suppose it depends on the state.

In Minnesota your own auto insurance pays the first 20K in medical.  After that it is the insurance of the at-fault driver (assuming you were not the one at fault) and it doesnt matter if they were legal to drive or not if they have an insurance policy.  The insurance is on the hook for it.  If they have no insurance, or not enough (med costs exceed their coverage) the claim then moved to the underinsured/without insurance portion of your own auto insurance (usually the same limits as your primary liability) which then pays and it is up to your own company to go after them to subrogate costs, not yours, unless your costs then exceed THAT coverage as well, at which point your own health insurance kicks in.

 Yeah. Same here to some extent ( personel auto insurance)  However since I was not in my POV but company truck my insurance was not an option.  But after a second Dr. saw me and ran tests ( first Dr. didn't run any) and an MRI, injury ended up being neck injury not my back/ shoulder. For some reason then it was an Okay work comp claim and they have decided they will pay now. Just waiting for them to do so.

 NEWEST UPDATE!!Since last posts I've been really busy and haven't kept you all updated. Sorry about that.  After my MRI I found out that my injuries were not my back/ shoulder but my neck. Am waiting for appointment with a neurological seurgon ( spelling?)  That will be on the 25th. (tuesday) still off work indefinately BUt work comp has decided to take care of medical bills and lost wages (somewhat) My weekly check at work was around $950.00 after tax now on comp it's only $725.00 so I'm having to "cut back" some but NOT on the important things like my preps They are priority after household bills.

 After my accident I realized I am getting to old to take advantage of my body any longer. I had quit smoking over a year ago so That was good, BUT the other things I've done is cutting way back on the soft drinks, was drinking 3-4 of the liter size pepsis DAILY.  Now I am down to a couple of 12 oz. ones a day. Drinking a lot more water now, cut the candy and sweets by about 75% and eating more fruits and such LOVE dehyd, pineapple and papaya eating them instead of candy/sweets. Stopped the fast foods completely, reduced fried foods by half. Eating mostly grilled foods like fish, chicken, grilled veggies like corn, asparagus, and such.  Walking at least 1/2-1 mile a day. Working on finishing up cleaning up garage so I can use our bowflex soon.

 Doing this has made me feel better, sleep better, and even get closer with the wife.  Now once this injury thing is done I think I'll be a whole lot better off.

 Maybe I/we should start a thread about what We do each day to be healthier? That way we can encourage each other as we go along?

Great news OS! keep up that healing thing ... all of it. Sounds like you are on the right track with those dietary changes, several others on the forum have commented about the benefits of high protein (only high quality) low carbohydrate diets. And making the total change you are with dropping more of those HFCS (high fructose corn syrup) is only going to help you feel better. Try eating one or two teaspoons of honey just before bed time, that perfect balance of glucose and sucrose helps your body properly digest carbs. Eat real food, mostly vegetables that's what they say. Have not found anyone who says we need more carbs in the 21st century human diet.
